Terms of Service

The rules for using H2H, requesting home services, offering professional services, and handling marketplace transactions.

Version 1.1 · Effective date: [EFFECTIVE DATE] · Last updated: [LAST UPDATED]

This page is a draft. Bracketed details and operating rules still need confirmation. It should not be treated as final legal guidance.

1. Agreement and eligibility

These Terms form an agreement between you and H2H (“we”, “us”, or “our”). By creating an account or using H2H, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. You must be at least [MINIMUM ELIGIBLE AGE], able to form a binding agreement, and legally permitted to use H2H in your location.

2. The H2H service

H2H operates a marketplace that helps customers find and book independent home-service professionals. Unless expressly stated otherwise, H2H is not the provider of the home service and does not employ or supervise a professional’s day-to-day work. Professionals are responsible for their listings, qualifications, conduct, work, and compliance with applicable law. H2H may facilitate booking communications and payment processing, administer marketplace rules, and assist with disputes, but cannot guarantee a particular outcome or professional availability.

3. Accounts and security

Provide accurate information, keep your sign-in credentials and devices secure, and promptly notify H2H of suspected unauthorized access. You are responsible for activity on your account except where applicable law provides otherwise. One account may support customer and professional use. Professional status may require identity or document checks and approval. H2H may request updated information to maintain account security or marketplace integrity.

4. Bookings and service locations

A booking request is not accepted until the professional confirms it in H2H. Review the service description, scope, price, timing, cancellation terms, and location before confirming. Do not submit an address unless you are authorized to arrange work there. Communicate changes through the booking and promptly tell the other party about access or safety issues. The precise cancellation windows, no-show rules, and rescheduling consequences must be shown in the app and are currently [INSERT APPROVED BOOKING CANCELLATION AND RESCHEDULING RULES].

5. Prices, payments, and refunds

Prices, platform fees, applicable taxes, payment methods, and any professional payout deductions should be presented before a transaction is confirmed. H2H may collect customer payments and facilitate professional payouts under the applicable payment flow. Payment providers may apply their own terms. Refunds, reversals, and dispute outcomes are governed by the separate Refund Policy. [CONFIRM TAX, FEE DISPLAY, PAYMENT AUTHORIZATION, ESCROW/CUSTODY, AND PROVIDER TERMS].

6. Acceptable use

You must not:

  • Break the law, threaten or harass another person, discriminate, or create a safety risk.
  • Misrepresent your identity, qualifications, service, location, price, or ability to perform a job.
  • Use H2H to defraud, manipulate reviews or bookings, evade platform safeguards, or interfere with another user’s account.
  • Upload malware, unlawful material, another person’s private information without permission, or content that infringes intellectual-property rights.
  • Scrape, reverse engineer, disrupt, or attempt unauthorized access to H2H, except to the extent such restriction is prohibited by law.
  • Take a booking off-platform to avoid an agreed fee or safety process where applicable law permits H2H to restrict that conduct.

7. Content and intellectual property

You retain ownership of content you submit, including profile materials, messages, reviews, and photos. You grant H2H a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt for technical formatting, and distribute that content only as reasonably needed to operate, secure, promote, and improve H2H and the marketplace. You confirm you have the rights needed to submit it. You may request removal, subject to transaction records, legal obligations, dispute evidence, and other users’ rights. H2H and its licensors own the app, software, branding, and other H2H materials. Do not use them without permission.

8. Reviews and marketplace content

Reviews should reflect genuine service experiences and must not contain threats, unlawful discrimination, personal data unrelated to the job, or fabricated claims. H2H may moderate, restrict, or remove content that violates these Terms or applicable law. We do not endorse every statement made by users.

9. Suspension and termination

You may stop using H2H and request account closure by emailing info@h2h.work. H2H may restrict or suspend access when reasonably necessary for safety, suspected fraud, legal compliance, or a material breach, and will provide notice or an opportunity to respond where appropriate and lawful. Sections that by their nature should continue, including payment obligations, intellectual-property licenses for already-used content, disclaimers, and liability provisions, survive termination.

10. Disclaimers

To the maximum extent permitted by law, H2H is provided “as is” and “as available”. We do not warrant uninterrupted availability, error-free operation, or that a marketplace user will meet your expectations. Nothing in these Terms excludes consumer rights, guarantees, or other protections that cannot lawfully be excluded.

11. Liability

To the maximum extent permitted by applicable law, H2H is not liable for indirect, incidental, special, consequential, or punitive loss, or loss of profits, data, or goodwill. H2H’s aggregate liability arising from the service will not exceed [INSERT LEGALLY REVIEWED LIABILITY CAP AND LOOK-BACK PERIOD]. These limits do not apply where prohibited by law, including liability that cannot legally be limited, or affect non-waivable consumer rights.

12. Indemnity

To the extent permitted by law, you are responsible for claims arising from your unlawful conduct, material breach of these Terms, or infringement of another person’s rights. Any indemnity applies only to the extent the claim was caused by your conduct and does not waive rights that cannot legally be waived.

13. Governing law and disputes

These Terms are governed by the laws of [CONFIRM GOVERNING JURISDICTION], without displacing mandatory consumer protections. Courts located in [CONFIRM COMPETENT VENUE] will hear disputes, subject to non-waivable rights and any required local process. No arbitration or class-action waiver is created by this draft. Obtain local advice before adding one.

14. Changes and contact

We may update these Terms to reflect service or legal changes. We will post the revised version and update the date above, and give additional notice where required. Continued use after changes take effect means you accept them only where permitted by law. Contact info@h2h.work.
